Can my Landlord Enter my Home?

All You Need to Know About Right of Entry

Today we had an incident with a tenant regarding right of entry. There was a leak in the roof that happened earlier this week. When we were notified at the end of the week, we immediately got someone to go there. Tenant felt they should have 24 hours of notice and still use their right of privacy.  Google says "If a landlord enters your home without permission they are, technically, trespassing, unless they have a court order to allow them otherwise." The lease says we need to be notified within the same day of water leaks or mildew growth, we then have the right to exercise all rights and remedies, including entering. So what is and isn't allowed? Well, according to the ND Century Code 47-16-07.3 "At any time in case of emergency we have the right to enter during reasonable hours of the day." With that being said, we absolutely are allowed to enter during reasonable hours of the day, even if we don't have permission from the tenant.
